When a person passes away and leaves a Will, the executor named in the Will is required to obtain a Grant of Probate from the Supreme Court. This confirms the Will as valid and gives authority to the executor to deal with the assets of the deceased estate.
Applying for a Grant of Probate is a challenging process, with very particular requirements that must be satisfied before a grant will be issued. Our experienced team can see the application through for you with a minimum of stress. A fixed fee of $1500 (ex GST) is charged for probate applications.
Often a person is taken from us unexpectedly, with the result that no Will is left to direct what to do with their estate – a situation known as intestacy. With an intestacy, there are special rules under the Administration Act as to how the estate will be divided. A person who is entitled under the rules will need to apply to the Supreme Court for Letters of Administration, which authorises the person to deal with the estate. Understanding the intestacy rules and the requirements for a grant of Letters of Administration is difficult.
To avoid a lengthy application having to be made by your family, we recommend everyone to have a valid Will.
